Mediation and Arbitration
A quick Google search can tell you all you need about Mediation and Arbitration. They are alternative methods to resolving disputes outside of court. Mediation and Arbitration are cost effective, likely result in a quicker resolution than traditional litigation, confidential, flexible and worthwhile. Mediation allows the parties to retain control over the outcome while avoiding the stress and expense of traditional litigation. Mediation is a method by which the Mediator attempts to facilitate a resolution between the parties. Unlike traditional litigation, Mediation allows the parties a full platform to discuss their concerns. There are no rules of evidence that apply to Mediation sessions.
As a certified Mediator, Judge and now again as a Mediator, I have handled countless cases and have successfully mediated many. Mediation is useful in all aspects of a court case including civil disputes, contractual disputes, and even family disputes such as custody and divorce.
According to the U.S. Office of Special Counsel, the advantages of Mediation are critical. Mediation sessions are informal, confidential, quick and inexpensive, provide a greater degree of party control, preserve relationships, provide far more satisfied parties with mutually satisfactory results, provide for comprehensive and compromised agreements and provide a foundation for future problem solving.
Mediations can be used and utilized in every type of court related matter and with any type of litigant. Mediation is the wave of the future when it comes to resolving disputes.
Arbitration, which is different than Mediation, can be an efficient and cost-effective way to resolve disputes. Atbitration a neutral forum that can be customized to the needs of the parties involved. The parties can select a preferred Arbitrator, taking into account the Arbitrator’s experience, expertise and other skills. The parties usually agree on the Arbitrator, so that both sides have the confidence that the proceedings will be impartial and that the dispute will be resolved sooner than traditional litigation, allows the participants to effectively engage in the process without being constrained by certain evidentiary rules, and provide the parties finality.
